                   AN ORDINANCE CLOSING AND ABANDONING AN ALLEY
                   LOCATED SOUTHWEST FROM RIVERVIEW ROAD, BETWEEN
                   FALMOUTH ROAD AND LAWRENCE STREET, MORE
                   PARTICULARLY DESCRIBED HEREIN, UPON CERTAIN
                   CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned an alley located southwest from Riverview Road,
         between Falmouth Road and Lawrence Street, more particularly
         described herein, and as shown on plat attached hereto and made 
a
         part hereof by reference:
        
                A 20 foot wide unopened alleyway beginning on the
                southeast line of Riverview Road some 351 feet
                (plat), or 344.12 feet (map), southeast, then
                northeast, of the intersection of the southwest
                line of Riverview Road with the southeast line of
                Falmouth Road, thence northeast some 22 feet with
                Riverview Road, thence southwest some 879.66 feet
                (plat), or 877.72 feet (map), to the northeast line
                of Lexington Road, thence northwest 20 feet with
                Lexington Road, thence northeast some 865.12 feet
                (plat), or 879.42 feet (map), to the southeast line
                of Riverview Road, the point of beginning.  Said
                alleyway separates lots 1-4 and lot 6, from lots
                10-14, lot 7, and lot 16, Riverview Addition No. 2,
                as shown by plat of record in plat book 6, page 5,
                ROHC.  Tax Map No. 127P-U-3, 4, 7, 9-11, and 13-17.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The reservation for Jupiter Industries, Inc.,
                   d/b/a Chattanooga Gas Company, of an easement
                   the width of the street for its gas main, lines
                   and other distribution facilities located within
                   the petitioned right-of-way, which must be
                   maintained for the use and benefit of its
                   customers.
               
                2. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                3. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
